The ELAN Skin Privacy Notice describes how medical information about you may be used and disclosed and how you can obtain access to this information. Please review it carefully.


We wish to protect the privacy of your Personal Health Information (referred to herein as “PHI”). PHI includes any individually identifiable information that we obtain from you or others that relates to your past, present or future physical health, the health care you have received, or payment for your health care.
This notice provides you with information about our uses, disclosures, and privacy practices with respect to your PHI. We reserve the right to change the terms of this notice from time to time and to make the revised notice effective for all PHI we maintain.

Uses and Disclosures of Personal Health Information

We can use or disclose your PHI, as necessary, for the purpose of treatment, payment or health care operations relating to the services rendered at ELAN Skin.
Example of uses of your health information for treatment purposes:
A nurse obtains treatment information about you and records it in a health record. The doctor reviews the health record and may discuss the treatment with the nurse. 

Example of use of your health information for payment purposes:

We submit a request for payment to your credit card company. The credit card company requests information from us to verify the medical care given. We will provide information to them about you and the treatments given.

Example of Use of Your Information for Health Care Operations:

We obtain services from our business associates such as protocol development, training programs, medical review, and legal services. We will share information about you with such business associates as necessary to obtain these services.

Other Uses of your PHI

We may contact you to provide appointment reminders for treatment or care.

We may contact you as part of our marketing efforts as permitted by law. You may opt out of receiving such marketing communications.

We will disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to:

(a) conform to the edicts of the law, comply with legal process served on us, or to investigate and prosecute criminal conduct on our premises;

(b) protect and defend the rights or property of the ELAN Skin, including the use within a lawsuit or dispute;

(c) act under exigent circumstances to protect the personal health and safety of our users or the public; and,

(d) to communicate with federal or state agencies that oversee our activities.

We may disclose your personal information in conjunction with a merger, acquisition, bankruptcy, asset sale or other transaction regarding ELAN Skin. All such disclosures will conform to the applicable state and federal privacy laws.

Your Rights

You have the right to inspect or obtain a copy of the PHI contained in our records except for information compiled in reasonable anticipation of, or for use in, a civil, criminal, or administrative action or proceeding.

In order to inspect or obtain a copy your PHI, you may submit your request in writing to our Privacy Officer at 3750 Hillsboro Pike, Nashville, TN, 37215.  If you request a copy, we may charge you a fee for the costs of copying and mailing your records, as well as other costs associated with your request.

HIPAA Notice

Due to the nature of the practice at ELAN Skin, we are not covered by The Health Insurance Portability and Accountability Act (HIPAA). This is because ELAN Skin is not a “Covered Entity” under HIPAA. A health care provider is covered under HIPAA if they submit certain transactions electronically. Typical transactions are billing, claims, eligibility status, and payment advice submitted to an insurance company. Since ELAN Skin does not deal with insurance companies, we do not submit those claims that would cause us to come under HIPAA. ELAN Skin does use credit card transactions for payment. However, credit card transactions do not qualify as one of the enumerated transactions that requires an entity to comply with HIPAA.
Nevertheless, we take the protection of your Personal Health Information very seriously.
